Dorneanu, Chirvase Law Firm, having its professional office in Bucharest, 103M Timișoara Boulevard, bl. 4, 1st entrance, 3rd floor, ap. 17, District 6 (hereinafter referred to as “Dorneanu & Chirvase“) in its capacity as personal data operator shall ensure that the processing of personal data takes place under the conditions and within the limits provided for by the applicable legislation in this field, including but not limited to the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter referred to as “GDPR“).

Categories of personal data processed

Dorneanu & Chirvase may process both personal data that you have provided to us directly and personal data lawfully obtained from public or other third party sources. 

Thus, Dorneanu & Chirvase processes, in particular, the following categories of personal data: (i) identification data (name and surname, date of birth, home address, personal numeric code, etc.); (ii) contact data (telephone number, fax number, e-mail address, correspondence address, etc.); (iii) data provided during the recruitment processes we initiate (such as the information provided in your CV e.g. the position you hold, data on your academic studies, etc. ); (iv) other relevant data arising from the contractual relationship with Dorneanu & Chirvase or communicated voluntarily by you (instructions given, payments made, information collected from public sources and databases, information regarding any legal matters, disputes, litigation or other legal actions in which you are involved in any capacity); (v) data resulting from your browsing on the website www.dorneanu-chirvase-avocati.ro collected through cookies and similar technologies.

Processing of personal data

Dorneanu & Chirvase processes your personal data in accordance with the applicable law for the following purposes: (i) the execution of the commitments undertaken towards you, including the performance of the activities carried out by Dorneanu & Chirvase in your interest and on your behalf by virtue of the legal assistance agreement entered into; (ii) the submission to the courts and other institutions, authorities, organizations and individuals as your conventional representative of the applications and other documents necessary for the execution of the mandate entrusted to you; (iii) the completion and submission of the declarations provided for by the applicable law; (iii) the fulfilment of the obligations relating to the payment and declaration of the fees; (iv) drawing up financial-accounting documents required by law; (v) managing and administering the IT and information processing system, as well as maintaining the IT applications and systems used by Dorneanu & Chirvase; (vi) archiving in accordance with the law; (vii) receiving and/or forwarding correspondence; (viii) defending the legitimate rights and interests under the mandate entrusted to Dorneanu & Chirvase; (ix) fulfilling the obligations imposed by law on lawyers; (x) communicating with you.

Your rights

According to the applicable legal provisions, you have the following rights with regard to the processing of your personal data: (i) the right to be informed about how your personal data will be used; (ii) the right of access to your personal data; (iii) the right to rectification of personal data if it is inaccurate or incomplete; (iv) the right to erasure of data or the “right to be forgotten”; (v) the right to restrict the processing of personal data beyond mere storage; (vi) the right to transfer data to be available to individuals as they wish to use it on other platforms or in other services; (vii) the right to object to the use of the data in marketing campaigns; (viii) the right not to be subject to a decision based solely on automated processing including profiling, which produces legal effects concerning the data subject or similarly affects him or her to a significant extent; (ix) the right to lodge complaints with the National Supervisory Authority for Personal Data Processing, in situations where you have been caused harm of any kind by the way your personal data is processed by Dorneanu & Chirvase.

Disclosure of personal data

Dorneanu & Chirvase may disclose your personal data to public institutions and third parties only in the cases and under the conditions provided by law and only in order to fulfill the commitments undertaken towards you according to the mandate entrusted to us. However, we try to minimize the amount of personal information we disclose to what is directly relevant and necessary to fulfill the specified purpose.

Dorneanu & Chirvase does not sell, rent or otherwise disclose personal information to third parties for marketing and advertising purposes without your consent.

Duration of storage of personal data

Dorneanu & Chirvase keeps your personal data for as long as it is necessary for the fulfillment of the commitments undertaken and to keep in touch with you.

In accordance with the legal provisions in force we are obliged to keep the relevant information for a minimum period of time for a possible investigation or litigation for law enforcement bodies, as well as for the duration required by law in the cases and conditions expressly and limitatively provided by law.

Once we no longer need to retain your personal information, we will order its deletion in a secure manner.
